Our services
We design, install, and operate AI systems for small businesses — marketing, customer communications, and operations, as described on this site. Descriptions on this site are general and are not an offer or a guarantee of any particular result. The specific work we do for you, the fees, and the timeline are set out in a separate written proposal or agreement between us. If anything in that signed agreement conflicts with these terms, that agreement controls.

ProBiz Advisors is a technology and consulting company, not a law firm. Nothing on this site and nothing we provide as part of our services is legal advice, and no attorney-client relationship is created by using this site, contacting us, or engaging us for services — even though our team includes a licensed attorney. For legal questions about your business, consult your own lawyer.
Using this site
You may use this site and our services only for lawful purposes. You agree not to:
- Use the site or our services to break the law, or to help someone else break it.
- Send us messages that are unlawful, harassing, deceptive, or infringe someone else's rights.
- Attempt to gain unauthorized access to our site, systems, accounts, or data.
- Interfere with or disrupt the site — including scraping, automated bulk access, or overloading our systems.
- Introduce malware or anything else designed to damage or interfere with our systems or our clients'.

Communications
When you contact us by phone, text, chat, or email, you consent to us communicating with you the same way. Our systems are AI-assisted and calls and messages may be recorded, transcribed, and stored. How we handle that information is described in our Privacy Policy. You can reply STOP to any text message to opt out of texts at any time.
SMS / Text Messaging Terms
Upon messaging opt-in, the end user agrees to receive messages from ProBiz Advisors (The ProBiz Group LLC d/b/a ProBiz Advisors) regarding responses to inquiries, requested information about our services, meeting scheduling and confirmations, and appointment reminders. End users can opt out by replying STOP or request more information by replying HELP. Message frequency varies. Message and data rates may apply. If you need assistance or have questions about our SMS service, reply with "HELP" to any SMS message you receive, or contact our customer support team at mark@theprobizadvisors.com.
You can opt out at any time by replying STOP to any message from us; you will receive a final confirmation of your opt-out and no further messages. Reply HELP for assistance at any time, or contact us at mark@theprobizadvisors.com or 702-849-2825.
Carriers are not liable for delayed or undelivered messages.
Consent to receive text messages from us is not a condition of purchase of any goods or services.

Intellectual property
The content on this site — text, design, logos, and marks — belongs to us. The tools, templates, methods, and know-how we use to build your systems remain ours. Ownership and license terms for anything we build specifically for you are set out in your written agreement with us.
Third-party services
Our services rely on third-party platforms — including communications, hosting, calendar, payment, and AI providers — and this site may link to third-party sites. We don't control those services, we're not responsible for them, and their terms and privacy policies apply to your use of them. An outage, price change, policy change, or failure at a third-party provider is not our fault, though we'll work with you in good faith to address it.
No warranties
This site and our services are provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site or our services will be uninterrupted, error-free, or secure, that AI-generated output will be accurate or suitable for any purpose, or that you will achieve any particular revenue, lead volume, or business result. You are responsible for reviewing output and for how you use it in your business.
Limitation of liability
To the fullest extent permitted by law, ProBiz Advisors and its owners, members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, lost data, or business interruption, arising out of or relating to this site or our services — even if we were advised such damages were possible.
Our total liability for all claims arising out of or relating to this site or our services is limited to the amount you actually paid us in the three months before the event giving rise to the claim, or $100 if you haven't paid us anything.
Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold ProBiz Advisors harmless from claims, losses, and reasonable expenses (including attorneys' fees) arising from your misuse of the site or our services, your violation of these terms, or your violation of any law or third-party right — including any claim arising from messages sent to your customers or contacts using systems we build for you.
Your compliance obligations
If we build systems that communicate with your customers, you are responsible for the content those systems send on your behalf and for having a lawful basis and any required consent to contact your customers — including under telemarketing, texting, email, and recording laws. We'll build to the requirements we're told about, but we can't verify your consent records for you.
Governing law
These terms and any dispute arising out of them or out of our services are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. You and we agree that any dispute will be brought exclusively in the state or federal courts located in Clark County, Nevada, and we each consent to the jurisdiction of those courts.
Changes to these terms
We may update these terms from time to time. The updated version will be posted here with a new effective date, and it applies to your use of the site going forward. If a change materially affects work already underway for you, we'll tell you.
Miscellaneous
If any part of these terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver of it. These terms, together with any signed agreement between us, are the entire agreement about this subject.
